the licence requirements specify commercial licences are valid on a single machine only.

we have a situation where we expect the site to expand where we will require a load-balanced paid of machines. do I need to buy 2 licences? both servers would run the exact same server and be accessed from the same url.

If it's purely for failover, then one license is okay, as it's only being used on one machine at a time. We do offer discounts for multiple license purchases, and I would be happy to discuss any licensing requirements you might have over email (mikeday@yeslogic.com).
